Miami-Dade Jurors Return $95 Million Verdict
Davis Goldman Co-Managing Partner Aaron Davis recently spoke to the Daily Business Review about representing the surviving parents whose daughter was killed and son left dependent on constant medical care after a head-on collision caused by a drunk driver.
The $95 million verdict secured by Aaron Davis and Leesfield Scolaro Partner Adam Rose has become the second-largest motor vehicle-related accident verdict at the Miami-Dade Circuit Court and the ninth-largest in Florida history, according to VerdictSearch.
“There’s no amount of money that could ever compensate a family for going through a loss like this,” Davis said. “The biggest challenge is to explain to a family that no matter what we do, you will never be able to put yourself back into the position you were in before this tragedy happened.”

Here’s How In-House Legal Leaders Can Help Companies Weather a Recession
In a recent Q and A with Corporate Counsel, Davis Goldman Co-Managing Partner Jason Goldman discusses the challenges a recession could present to legal departments, and how in-house lawyers can prepare.
As in-house legal departments are generally overloaded, to begin with, a recession could significantly increase their workload with matters likely involving employment litigation, bankruptcies, collectings actions, and shareholder disputes. Jason advises departments without a plan to get started sooner rather than later, as proper planning and transparency among stakeholders are essential to surviving an economic downturn.
“The natural result of a downturn could be stagnant wage growth, layoffs and cutting back on intangible perks, no free lunches, holiday parties, things like that. All that equates to less happy employees or less employees. Sometimes that will lead to an opportunity for litigation. If there is a need for layoffs, being as transparent as an employer can de-escalate tensions that might otherwise result in opportunities for disputes that could turn into litigation.”

Liability Waivers Under Scrutiny After Parasailing Death: ‘You Can’t Sign Away Gross Negligence’
Davis Goldman Associate Michael Bild recently spoke to the Daily Business Review about the unenforceability of liability waivers following a fatal parasailing accident in the Florida Keys.
For anyone taking part in high-risk activities, Mr. Bild suggests keeping a copy of liability waivers on file to present to their attorney in the event of personal injury.
“Every lawyer has a different perspective on a case. We have many cases similar to this where our clients were turned down by other attorneys because they didn’t think it was a case, but we were willing to take it on to see if it turned out to be a case,” Bild told ALM Reporter Jasmine Floyd. “Just because one lawyer declined to take your case doesn’t mean that’s the end of the inquiry. Go ahead and ask other attorneys, and get different perspectives on the issue.”
