Closing Florida Loophole in Medical Negligence Cases
Florida Daily discusses a long-standing loophole in Florida’s medical negligence laws that limits families’ ability to seek justice in wrongful death cases. Under current law, parents cannot file a medical malpractice wrongful death lawsuit if their unmarried child was 25 or older, nor can adult children sue if their unmarried parent dies due to medical negligence.
Co-Managing Partner Aaron Davis emphasizes the critical need to close this legislative gap, noting that Florida remains one of the few states with such restrictive provisions. He highlights that enacting this reform would align Florida with the majority of the country, ensuring fair and equitable legal recourse for all victims of medical negligence.
