Judge Orders State Farm To Restart Paying PIP Claims To Co.
Co-Managing Partner Jason Goldman was recently featured in Law360 discussing a major win for his client, Complete Care Centers, in litigation against State Farm. Jason highlights the court’s ruling that State Farm must resume processing personal injury protection (PIP) claims submitted by Complete Care Centers for payment. The court found State Farm’s failure to pay what appears to be several million dollars of PIP claims to Complete Care Centers was improper. The decision reinforces that insurers cannot unilaterally decide for themselves that certain health care providers are ineligible to receive any PIP payments, until a court decides otherwise, State Farm cannot simply decide to stop paying all claims for PIP benefits to a medical provider. He explains how this decision protects patients’ rights to access care and ensures that providers are treated fairly under the law.
“This is about protecting Florida drivers’ access to care after an accident, and most importantly it protects patients’ rights to visit the doctor of their choice following an accident,” said Jason, who represents Complete Care and spoke with Law360 Reporter Carolina Bolado. “The court made clear that insurers like State Farm cannot act as the accuser, judge, jury and executioner by unilaterally refusing to process and pay all claims for PIP benefits submitted by a particular medical provider.”
