
Liability Waivers Under Scrutiny After Parasailing Death: ‘You Can’t Sign Away Gross Negligence’
Davis Goldman Associate Michael Bild recently spoke to the Daily Business Review about the unenforceability of liability waivers following a fatal parasailing accident in the Florida Keys.
For anyone taking part in high-risk activities, Mr. Bild suggests keeping a copy of liability waivers on file to present to their attorney in the event of personal injury.
“Every lawyer has a different perspective on a case. We have many cases similar to this where our clients were turned down by other attorneys because they didn’t think it was a case, but we were willing to take it on to see if it turned out to be a case,” Bild told ALM Reporter Jasmine Floyd. “Just because one lawyer declined to take your case doesn’t mean that’s the end of the inquiry. Go ahead and ask other attorneys, and get different perspectives on the issue.”
