What Fla. Litigators Are Eyeing In 2025
Law360 explores the significant changes Florida courts will encounter in 2025, with attorneys closely tracking several factors potentially redefining litigation. From revised civil case management rules to contentious tort reforms and social media regulations, this year is set to bring major transformations to the legal landscape.
Co-Managing Partner Jason Goldman offers his insights on Florida’s evolving tort reform law and its potential impact. As courts continue to navigate the complexities, a key appellate ruling in late 2024 clarified the law’s prospective (as opposed to retroactive) application following enactment in March 2023.
Jason says it is unclear whether the decision will be appealed further or if the Florida Supreme Court would consider the issue without a district split. For now, however, the decision is binding on trial courts in the state, even those outside of the Fifth District because it is so far the only appellate decision to address the law’s prospective application, according to Jason, who expects other appellate courts in the state to weigh in during the coming year.
